Domestic violence includes physical and sexual abuse, emotional or psychological abuse, economic abuse, threatening or coercive behaviour, and controlling or dominating behaviour (Domestic and Family Violence Protection Act 2012 (QLD))Relevant relationships include current and former intimate partners, family members (including extended family), and informal care relationships. The behaviour may be directed at a person’s property, animals, or other people as a means of coercion or control. 

Yes. A single act is considered domestic violence as it does not need to be a pattern of behaviour.  

A Domestic Violence Order (DVO) is a legally binding document issued by a court to protect a person from domestic violence. The protected person is referred to as the “aggrieved”, while the person the order is made against is referred to as the “respondent”. DVOs can be applied for by the aggrieved directly, or by police on their behalf.

The conditions of a DVO vary depending on the circumstances, but often include restrictions on contact, such as by phone, social media, or in person. It may also include exclusion zones that prevent the respondent from approaching the home, workplace or other locations the aggrieved frequents.

If police attend a domestic violence incident, they can issue a Police Protection Notice on the spot. This operates like a temporary order without any immediate court attendance required, however it is referred to the Magistrates court which means a court date will follow.

Legal representation for domestic violence matters is not mandatory, but it is strongly recommended. A lawyer understands the process and will help navigate the complexities of your case to ensure you get a fair outcome. 

Under Queensland law, a child who witnesses or is exposed to domestic violence is considered to have experienced domestic violence themselves. Children can be listed as named persons on a Domestic Violence Order for protection. This is common where children are part of the household or are at risk from the respondent’s behaviour. DVOs and family law orders operate concurrently but under different legal frameworks.
